These Terms and Conditions govern the sale of bespoke celebration cakes and related products and services by Bake Tasty (trading in the United Kingdom) through https://www.baketasty.co.uk/. By placing an order you agree to these Terms. If you do not agree, do not place an order.

1 Who we are and how to contact us

Seller: Bake Tasty (trading in the United Kingdom). Contact email: sales@baketasty.co.uk. Governing law: English law; disputes subject to the courts of England and Wales except where mandatory consumer protection law provides otherwise.

2 Orders, quotations and contract formation

  • Quotations: Any estimate or quotation is valid for the period stated or, if none is stated, for 14 days.

  • Placing an order: Orders may be placed via the website, email, or other channels we provide. Bespoke orders require specification of design, size, flavours, dietary requirements, event date, and collection/delivery details.

  • Deposit: Bespoke orders require a non‑refundable deposit (amount or percentage stated at time of order) to secure the booking and begin work. The deposit is deducted from the final price.

  • Contract formation: A contract is formed when we send an order confirmation email. We may refuse or cancel orders for legitimate business reasons (for example, if we cannot meet the requested date).

3 Price, payment and changes

  • Prices: All prices are in GBP and include VAT where applicable. The final price is confirmed in your order confirmation.

  • Payment: Full payment or the balance is due by the date specified in the order confirmation, normally before collection or delivery. We accept the payment methods shown at checkout. We do not store full payment card details on our servers when a third‑party payment processor is used.

  • Price changes: We will not increase the price after a contract is formed except where required by law or where you change the order. We may change prices for new orders at any time.

4 Delivery, delivery tiers and collection

  • Delivery tiers: Delivery is available only for orders placed under our Delivery Tier or Premium Delivery options. Orders placed under other tiers are collection only. The availability of delivery for a specific order will be shown at the time of booking.

  • Delivery area: If you require delivery it must be within a 10 mile radius of Cuffley, EN6. The radius is measured by typical driving distance and is approximate; we will confirm eligibility when you place your order. If your address falls outside this area we cannot offer delivery and the order will be collection only unless otherwise agreed in writing.

  • Requesting delivery: Delivery must be requested and paid for at the time of ordering. Delivery fees apply and will be quoted at checkout or in your order confirmation.

  • Delivery times: Delivery times are estimates. We will use reasonable efforts to meet agreed delivery windows but cannot guarantee exact arrival times.

  • On delivery: You must provide safe, legal access and a suitable delivery location. Risk of loss or damage passes to you on delivery. You must inspect the cake on delivery and notify the driver or us immediately of any visible damage. If you accept the cake without noting damage, it may affect your rights.

  • Failed delivery and re‑delivery: If delivery cannot be completed due to no access, incorrect address, or other reasons outside our control, we may charge a re‑delivery fee and/or treat the order as collected by you at the original delivery address. We are not responsible for delays caused by traffic, weather, or other events outside our control.

  • Collection: If you choose collection, you must collect at the agreed time. We are not responsible for damage or deterioration after the agreed collection time. If you are late collecting we may charge a storage fee or, if prolonged, treat the order as cancelled in accordance with these Terms.

5 Lead times, storage and handling

  • Lead times: Bespoke cakes require advance notice. Lead times are stated at the time of ordering and may vary by complexity and season. You must provide accurate event date and collection/delivery details.

  • Storage and handling: Cakes are perishable. We will provide storage and handling instructions; failure to follow them may affect quality and is your responsibility. We are not liable for deterioration after delivery or collection if instructions are not followed.

6 Bespoke design, ingredients and allergens

  • Designs: We will make the cake to the agreed design. Minor variations may occur due to the handmade nature of our products. If you provide images or artwork, you confirm you have the right to use them.

  • Ingredients and allergens: You must tell us of any allergies, intolerances, or dietary requirements at the time of ordering. We will use reasonable care to avoid cross‑contamination but cannot guarantee an allergen‑free environment. We are not liable for allergic reactions where you have not informed us or where cross‑contamination occurs despite reasonable precautions.

  • Custom requests: Requests for unusual ingredients, structural elements, or edible decorations must be agreed in advance and may affect price and lead time.

7 Cancellation, changes and refunds

  • Your right to cancel: For consumers, statutory cancellation rights may apply to certain online purchases. However, bespoke perishable goods made to your specifications (for example custom celebration cakes) are generally excluded from the right to cancel once production has started. We will confirm cancellation rights at the time of order.

  • Changes by you: If you request changes to a bespoke order after confirmation, we will try to accommodate them but cannot guarantee availability; additional charges may apply.

  • Cancellation by us: We may cancel an order for reasons beyond our control or if we cannot meet the agreed date; in that case we will refund any sums paid.

  • Faulty goods: If the cake is faulty or not as described, we will, at our option, repair, replace, or refund in accordance with your statutory rights. To make a claim you must notify us promptly and provide photos and details.

  • Deposit and refunds: Deposits for bespoke orders are non‑refundable where loss is reasonably incurred (for example where we have begun work or reserved the date). Refunds, where due, will be processed using the original payment method.

8 Liability and limitations

  • Liability cap: Our liability for direct loss caused by our negligence is limited to the price paid for the goods or services, except where liability cannot be limited by law (for example death or personal injury caused by negligence).

  • No liability for indirect loss: We are not liable for indirect or consequential losses (for example lost profits, event cancellation costs) except where required by law.

  • Food safety: We prepare food in a kitchen environment that may handle allergens. We follow food safety and hygiene standards; you are responsible for following storage and serving instructions.

9 Intellectual property and marketing

  • Ownership: All intellectual property rights in our website content, recipes, images, and branding remain with us or our licensors.

  • Customer images: By placing an order you grant us a non‑exclusive licence to use photographs of the finished cake for marketing and social media unless you expressly request otherwise at the time of ordering.

10 Force majeure

We are not liable for failure to perform obligations caused by events beyond our reasonable control (for example extreme weather, supply shortages, public health restrictions). If such an event affects your order we will notify you and propose reasonable alternatives.

11 Complaints and dispute resolution

  • Complaints: Contact sales@baketasty.co.uk with order details and photos if relevant. We will acknowledge and investigate promptly.

  • Alternative dispute resolution: Consumers have the right to refer disputes to UK alternative dispute resolution schemes or to the courts. You may also contact the Information Commissioner’s Office about data protection concerns.

12 Data protection

We process personal data in accordance with our Privacy Policy. By ordering you consent to the use of your personal data for order fulfilment, communications, and legal compliance. For privacy queries contact sales@baketasty.co.uk.

13 Changes to these Terms

We may update these Terms from time to time. Material changes will be notified on the website or by email where appropriate. Continued use after changes constitutes acceptance.
